Jennifer Upton

 

Jennifer is a skilled litigator whose practice focuses on trust and estate litigation, guardianship matters, fiduciary disputes, and commercial litigation. She represents clients in a range of contested matters and is committed to providing direct access, responsive communication, and practical advice through every stage of a matter.  

 

A substantial portion Jennifer's practice is devoted to trust, estate, and fiduciary litigation. She represents beneficiaries, trustees, and personal representatives in disputes involving will contests, trust contests, breach of fiduciary duty claims, accountings, trust modification, and other complex probate and trust matters. Appreciating that these cases frequently involve both significant financial interests and deeply personal family relationships, Jennifer provides thoughtful counsel with practical litigation strategies tailored to each client's objectives. 

 

Jennifer also represents clients in guardianship and conservatorship proceedings, advising families and fiduciaries in matters involving the protection of incapacitated individuals. These matters include proceedings to appoint guardians and conservators, contested guardianships, and disputes concerning guardianship and conservatorship administration. Her approach balances strong advocacy with sensitivity to the personal and family dynamics that often accompany these cases. 

 

Beyond fiduciary and probate-related matters, Jennifer handles real estate partition actions, helping co-owners resolve disputes involving joint owned property through negotiated resolutions or, when necessary, litigation. Jennifer also maintains an active commercial litigation practice, representing clients in contract disputes, tort claims, partnership and shareholder conflicts, and other commercial controversies. She works closely with clients to develop litigation strategies that protect their interests while remaining focused on efficient and effective resolution.
